Editorial update: October 16, 2026. General educational information.
A fiduciary managing Wyoming mineral interests must identify the source and limits of authority under the trust, estate appointment, guardianship or conservatorship order and applicable law. Verify recorded title, lease and royalty interests, accounting duties, and whether court approval is required before a conveyance or mineral lease. Trustee, guardian and conservator powers are not interchangeable.
Three different roles
A trustee acts under the trust instrument and applicable trust law; a conservator typically administers a protected person’s property under court appointment; a guardian primarily addresses the personal welfare and care of the ward. Do not treat an appointment as guardian alone as unlimited authority to sell or encumber the ward’s mineral property.
Trustee’s duties
Wyoming’s Uniform Trust Code addresses administration, loyalty, impartiality, property records and beneficiary information. Under Wyo. Stat. §§ 4-10-802, 4-10-804 and 4-10-810, review loyalty, prudent administration and adequate records; § 4-10-810 also addresses separation, titling and combined investment of separately recorded trusts. Section 4-10-813 concerns qualified beneficiaries and includes information and reporting duties. Its subsections distinguish trust-instrument directions, limits or waivers for subsection (b), beneficiary waivers under subsection (d), and the election available to certain trusts irrevocable before July 1, 2003 under subsection (e). Review the trust, beneficiary status and applicable exceptions before stating a reporting entitlement.
Prudent investor analysis
Wyo. Stat. § 4-10-902 evaluates management decisions in the context of the trust portfolio and relevant risk-return objectives. Consider producing income, concentration in a single basin, title risk, costs to administer, and plausible redevelopment potential. Neither a blanket rule to sell declining mineral interests nor a rule to retain them indefinitely satisfies the necessary individualized analysis.
Conservatorships and reporting
Wyoming conservatorship statutes address management powers and required reporting. Wyo. Stat. § 3-3-901 generally calls for annual verified accounting within 60 days after the anniversary of appointment unless otherwise ordered, with reports in specified other circumstances. Section 3-3-902 describes accounting content. Confirm the particular court’s order and current procedural requirements.
Conflicts and self-dealing
A trustee, professional adviser, title agent or related mineral buyer should not exploit a fiduciary relationship to acquire client or trust property without independent analysis of the actual authority, fair value, disclosure and required consent or court approval. In many circumstances conflict transactions are voidable.
Retain or sell framework
Prepare an independent valuation, ascertain operator and lease status, consider marketable title, document current and prospective income, seek comparable bids when useful, evaluate beneficiary needs and trust provisions, and preserve an audit trail of the decision.
Fiduciary workflow
Secure letters or trust certificate; organize original instruments; establish a separate deposit and accounting system; notify operators; reconcile checkstubs; calendar reports; document all proposed asset dispositions and conflicts; obtain legal advice when authority is disputed.
Authorities
Wyoming Judicial Branch — Guardianship and Conservatorship; Wyo. Stat. §§ 4-10-802, 4-10-804, 4-10-810, 4-10-813, 4-10-902, 3-3-901 and 3-3-902; Wyoming Legislature.
Bottom line
Do not rely on a checkstub, buyer offer or unexplained operator worksheet as proof of legal title or future reserves. Preserve the source documents and obtain appropriate professional review.
Sources and scope
This guide provides general education. Verify effective dates and the application of authorities to the particular facts. Consult the linked official sources and the original deeds, leases, orders and other records before acting. Browsing this guide or sending an inquiry does not create a professional engagement; services require a separate written agreement.
Legal-source review (October 2026): Trustee powers, prudence, loyalty, and recordkeeping must be evaluated under the controlling Wyoming trust instrument and the current Wyoming Uniform Trust Code. Guardianship and conservatorship are separate legal arrangements; do not assume a fiduciary can execute a mineral lease or convey mineral title without verifying the applicable authority, approvals, and recorded instruments.
