A royalty audit should reconcile recorded ownership, lease royalty, production volumes, prices, deductions, suspended proceeds and payment dates. Wyoming Statutes section 30-5-303 may provide remedies for qualifying violations, but an accounting discrepancy alone does not prove a statutory violation.
Identify each payor and property
Record operator, first purchaser or disbursing party, owner number, well or unit identification, legal description, producing formation and the separate oil, gas and NGL products. Keep original division orders and all revised ownership decimals.
Reconcile the payment chain
Compare production month, report date, pay date, volumes, realized price, lease or unit royalty share, percentage interest, post-production costs, severance taxes, prior-period adjustments, deductions and net proceeds. Avoid comparing a gross state production figure directly to a net sales figure without checking shrinkage and product attribution.
Check decimal changes and title events
Compare a new pay decimal against the lease, title opinion assumptions, unit factors and subsequent conveyances. Examine whether an ownership transfer, corrective deed, new well, depth change, revised allocation or erroneous pay deck caused the discrepancy.
Request written documentation
Ask the payor for accounting-detail reports, owner division-order history, suspense explanations, check detail, correction entries and the relevant lease or unit interpretation. Maintain a chronological request log and preservation copies; determine whether contract or statute supplies a deadline.
Wyoming Royalty Payment Act
Wyo. Stat. §§ 30-5-301 through 30-5-305 address timing and remedies for qualifying payments, including statutory interest in defined circumstances. Section 30-5-302 discusses escrow for proceeds that cannot presently be paid to the legally entitled owner. Payment minimums, valid agreements and timing exceptions must be checked against current text.
Find unclaimed money
Check the Wyoming State Treasurer’s unclaimed-property program, but distinguish funds still held in operator suspense or escrow from amounts already remitted to a state’s unclaimed-property custodian. Search every relevant owner name, predecessor and estate, and avoid paying unnecessary third-party claim fees.
Owner workflow
Establish a baseline accounting sheet; choose representative wells and production months; annotate each variance; prepare a concise written demand with document attachments; follow the governing dispute resolution rules; obtain specialist support for complex title and accounting disputes.
Authorities
Wyoming Attorney General — Royalty Payment Act; WOGCC; Wyoming State Treasurer — Unclaimed Property; Wyo. Stat. §§ 30-5-301 to 30-5-305.
Bottom line
Identify the legal property interest and relevant instruments, record the exact source of each assertion, preserve the evidence and use qualified independent professionals when title, fiduciary authority or legal remedies are disputed.
Sources and scope
This guide provides general education. Verify effective dates and the application of authorities to the particular facts. Consult the linked official sources and the original deeds, leases, orders and other records before acting. Browsing this guide or sending an inquiry does not create a professional engagement; services require a separate written agreement.
Statutory remedies safeguard: W.S. § 30-5-303 provides certain remedies for qualifying production-payment violations, but the entitlement to interest, costs, or attorney fees depends on the governing statutory conditions and evidence. An audit should separately reconcile volume, prices, deductions, royalty decimal, suspended proceeds, and actual payment dates before asserting a violation.
