Editorial update: October 16, 2026. General educational information.
Mineral estate accounting should reconcile recorded interests, production periods, operator checkstubs, withheld proceeds, receipts, expenses and beneficiary distributions. A fiduciary must distinguish income and principal in light of the governing instrument and Wyoming law; preserve supporting documents and explain unresolved differences.
Set up the mineral ledger
Assign each tract a unique asset code. Record legal description, interest type, owner fraction, operator, property or well ID, tax parcel references, applicable lease and beneficiary allocation. Keep a separate record for each state’s minerals and each producing unit.
Reconcile receipts
For each payment retain statement date, production period, oil/gas volumes, unit decimal, gross value, post-production costs, severance taxes, other adjustments, suspense release and net remittance. Reconcile deposits to bank statements and check annual reporting for timing or categorization discrepancies.
Track costs and tax reporting
Separate title research, probate and recording fees, legal fees, accounting, evaluation expense, administrative compensation and assessed taxes. Distinguish operator-reported deductions from fiduciary outlays. Tax allocations, depletion and basis adjustments require advice based on the owner’s actual legal and tax circumstances.
Fiduciary principal and income
Oil and gas royalty proceeds may raise principal-versus-income allocation issues for trusts, life tenants and remaindermen; review governing instruments and applicable law rather than assuming every royalty is current distributable income. A life tenant’s right to mineral royalties can be materially restricted.
Required disclosures and court reporting
Wyoming conservators report under Wyo. Stat. §§ 3-3-901 and 3-3-902. Trustees have a separate regime under § 4-10-813: subsection (a) addresses information for qualified beneficiaries, and subsection (c) calls for reports at least annually and at termination, as well as a report upon certain vacancies. Review trust terms, the beneficiary’s status, beneficiary waivers under subsection (d), and the election available to certain trusts irrevocable before July 1, 2003 under subsection (e). Section 4-10-810 separately addresses adequate records, property separation, titling and combined investment. Calendar the deadlines that actually apply to the fiduciary’s role.
Illustrative reconciliation
For one well, build columns: production month; payment date; payor and well; net barrels or MCF; price; ownership decimal; gross owner share; each deduction; severance tax; amount in suspense; cash received; unexplained variance. Roll the monthly results into annual financial statements.
Annual checklist
Reconcile every operator, update title and payor contact lists, investigate missing months, match 1099 forms where applicable, document fair-value assumptions for material holdings, record distributions, and issue beneficiary or court reports by their actual deadlines.
Authorities
Wyo. Stat. §§ 4-10-810 and 4-10-813 (trust records and reporting); §§ 3-3-901 and 3-3-902 (conservator reports); IRS for relevant federal tax guidance; review current official law and governing instruments.
Bottom line
Do not rely on a checkstub, buyer offer or unexplained operator worksheet as proof of legal title or future reserves. Preserve the source documents and obtain appropriate professional review.
Sources and scope

Fiduciary accounting review (October 2026): Mineral proceeds should be reconciled by owner, property, production month, payment date, operator, decimal interest, deductions, and suspense status. A trustee or personal representative should distinguish estate or trust income from principal according to the governing instrument and applicable Wyoming law; check original checkstubs, bank records, and recorded title rather than relying on summary totals.
